By using ShavyStays, you agree to the guidelines, terms and conditions set by ShavyStays.

The Terms of Service document is extremely comprehensive and regards your interaction with ShavyStays as an Owner or Patron. It covers issues like contracts, responsibilities and ShavyStays legal obligation to you.

Please read these terms of service carefully as they contain important information regarding your legal rights, remedies and obligations. These include various limitations and exclusions, jurisdiction and venue of disputes.

ShavyStays LLP (hereafter referred to as “ShavyStays”, “we”, “us”, or “our”) manages and markets the Owners property online and provides an online platform that connects owners who have places with Patrons seeking to book such accommodations (collectively, and also referred to as the “stay”, “stays”, “postings” “service”, or “services”), which are accessible at www.shavystays.com, ShavyStays social media accounts, ShavyStays WhatsApp and any other websites or apps through which ShavyStays makes the postings available (collectively, the “site”) and as an application for mobile devices (the “application”). By using the site and application, you agree to comply with and be legally bound by the terms and conditions of these Terms of service (collectively, the “terms”), whether or not you become a user of the postings. These Terms govern your access to and use of the site, application and postings and all collective content (defined below), and constitute a binding legal agreement between you and ShavyStays. Please read carefully these Terms and our Privacy Policy, and which is incorporated by reference into these Terms. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the site or application. Failure to use the site and application in accordance with these Terms may subject you to civil and criminal penalties.

The site, application and services comprise an online platform for Patron management of the owners properties through which ShavyStays creates Postings and Patrons may learn about and book such postings. You understand and agree that ShavyStays is not a party to any agreements entered into between owners and Patrons, nor is ShavyStays a real estate broker, agent or insurer. ShavyStays has no control over the conduct of Owners, Hosts, landlords, Patrons, Guests, customers, clients and other users of the site, application and services or any postings, and disclaims all liability in this regard.

ShavyStays reserves the right, at its sole discretion, to modify the site, application or services or to modify these Terms, including the service fees, at any time and without prior notice. If we modify these Terms, we will post the modification on the site or via the application or provide you with notice of the modification. We will also update the “Last Updated Date” at the top of these Terms. By continuing to access or use the site, application or services after we have posted a modification on the site or via the application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the site, application and services.The site, application and services can be used to facilitate the posting and booking of residential, holiday and other properties (also referred to as “stays”, “postings” or “villas”).ShavyStays makes available a platform or marketplace with related technology for Patrons and Owners to meet online and arrange for bookings of Postings. ShavyStays is not an owner or operator of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or accommodations, nor is it a provider of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or accommodations and ShavyStays does not own, sell, resell, furnish, provide, rent, re-rent, manage and/or control properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or accommodations or transportation or travel services.
ShavyStays responsibilities are limited to: (i) facilitating the availability of the site, application and services and (ii) serving as the limited agent of each Owner for the purpose of accepting payments from Patrons on behalf of the Owner. Similarly, ShavyStays is not a contracting agent or representative of any Owner. Instead, ShavyStays role is solely to facilitate the availability of the site, application and services for Patrons and to provide services related thereto.

{ShavyStays owned, managed and run properties will be mentioned as EXCLUSIVELY OWNED on all ShavyStays sites.}

Please note that, as stated above, the site, application and services are intended to be used to facilitate the booking of postings. ShavyStays cannot and does not control the content contained in any Postings and the condition, legality or suitability of any Postings. ShavyStays is not responsible for and disclaims any and all liability related to any and all Postings. Accordingly, any bookings will be made at the Patrons own risk.You understand and agree that ShavyStays does not act as an insurer or as a contracting agent for you as an Owner. If a Patron requests a booking of your place and stays at your accomodation, any agreement you enter into with such Patron is between you and the Patron and ShavyStays is not a party thereto. Notwithstanding the foregoing, ShavyStays serves as the limited authorized agent of the Owner for the purpose of accepting payments from patrons on behalf of the owner and is responsible for transmitting such payments to the owner.

ShavyStays recommends that owners obtain appropriate insurance for their properties. Please review any insurance policy that you may have for your place carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Patrons (and the individuals the Patron invites to the property, if applicable) while at your property.

No Endorsement

ShavyStays does not endorse any owners or any postings. In addition, although these Terms require Patrons to provide accurate information, we do not attempt to confirm, and do not confirm, any Patrons purported identity. This includes any owner or posting that ShavyStays may from time to time, select under its Featured Property/ Featured Owner program. You are responsible for determining the identity and suitability of others who you contact via the site, application and services.

By using the site, application or services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Patrons or other third parties will be limited to a claim against the particular Patrons or other third parties who caused you harm and you agree not to attempt to impose liability on, or seek any legal remedy from ShavyStays with respect to such actions or omissions. Accordingly, we encourage you to communicate directly with other Patrons on the site and services regarding any bookings or Postings made by you.

Bookings & Finance Terms

If you are an Owner and a booking is requested for your accommodation via the site, application and services, you will be required to either confirm or reject the booking within 24 hours. When you confirm a booking requested by a Patron, ShavyStays will send you an email, whatsapp, text message or message via the application confirming such booking, depending on the selections you make via the site, application and services.The fees displayed in each Posting are Owners Fees and the Patron Fees. Where applicable, Taxes may be charged in addition to the Owner Fees and Patron Fees. The Owners Fees, Patron Fees and applicable Taxes are collectively referred to as the “Total Fees”. The amounts due and payable by a Patron solely relating to an owner’s Posting are the “Owners Fees” and Please note that it is the Owner and not ShavyStays which determines the Owners Fees.

ShavyStays charges a fee to Patrons based upon a percentage of applicable owners fees which are the “Patron Fees”. The Patron Fees are added to the Owners Fees to calculate the Total Fees (which will also include applicable Taxes). ShavyStays will collect the Total Fees at the time of booking confirmation and will initiate payment of the owners Fees (less ShavyStays Patron Fees to the Owner within 24 hours of start of a reservation.. (except to the extent that a refund is due to the Patron).

Appointment of ShavyStays as Payment Agent for Owner

Each Owner hereby appoints ShavyStays as the owners limited agent solely for the purpose of collecting payments made by Patrons on behalf of the owner. Each owner agrees that payment made by a Patron to ShavyStays shall be considered the same as a payment made directly to the owner and the owner will make the property available to Patron in the agreed upon manner as if the owner has received the Owners Fees. Each owner agrees that, ShavyStays may, in accordance with the cancellation policy selected by the owner and reflected in the relevant Posting, (i) permit the Patron to cancel the booking and (ii) refund to the Patron that portion of the owners Fees specified in the applicable cancellation policy. In accepting appointment as the limited authorized agent of the owner, ShavyStays assumes no liability for any acts or omissions of the owner.

Please note that Posting or sharing of your property on ShavyStays is absolutely free.

Bookings and Financial Terms for Patrons

The Villa owners, not ShavyStays, are solely responsible for honoring any confirmed bookings and making available any Postings reserved through the site, application and services. If you, as a Patron, choose to enter into a transaction with a owner for the booking of a Villa, you agree and understand that you will be required to enter into an agreement with the owner and you agree to accept any terms, conditions, rules and restrictions associated with such Posting imposed by the owner. You acknowledge and agree that you, and not ShavyStays, will be responsible for performing the obligations of any such agreements, that ShavyStays is not a party to such agreements, and that, with the exception of its payment obligations hereunder, ShavyStays disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that ShavyStays is not a party to the agreement between you and the owner, ShavyStays acts as the Owners payment agent for the limited purpose of accepting payments from you on behalf of the owner. Upon your payment of amounts to ShavyStays which are due to the owner, your payment obligation to the owner for such amounts is extinguished, and ShavyStays is responsible for remitting such amounts, less ShavyStays Patron Fees, to the owner. In the event that ShavyStays does not remit any such amounts to an owner, such owner will have recourse only against ShavyStays.

You agree to pay ShavyStays for the Total Fees for any booking requested by you.

In connection with your requested booking, you will be asked to provide customary billing information such as name, billing address and credit/debit card information either to ShavyStays or its third party payment processor. You agree to pay ShavyStays for any confirmed bookings made in connection with your ShavyStays account in accordance with these Terms by one of the methods described on the site, messaged on whatsapp or application – e.g. by Googlepay. You hereby authorize the collection of such amounts by charging the credit/debit card provided as part of requesting the booking, either directly by ShavyStays or indirectly, via a third party online payment processor or by one of the payment methods described on the site or application. You also authorize ShavyStays to charge your credit/ debit card in the event of damage caused at a Posting as contemplated under “Damage to Postings” below and for Security Deposits, if applicable. If you are directed to ShavyStays third party payment processor, you may be subject to terms and conditions governing use of that third party’s service and that third party’s personal information collection practices. Please review such terms and conditions and privacy policy before using the services. Once your confirmed booking transaction is complete you will receive a confirmation email summarizing your confirmed booking.

In some cases, the owner may choose to receive payment of owners fees in cash at the time of arrival. Under this mode of payment, at the time of booking request, the applicable owners fee, Patron fees, along with applicable taxes will be displayed to the Patron. The Patron agrees to make the payment of owners fee at the time of booking confirmation and pay the owners fee at the time of check-in at the Site itself in cash. Please note that ShavyStays does not undertake any liability to the owner on account of non-payment or cancellation or no-show by the Patron. ShavyStays is not responsible for administering or accepting any claims by owners or the Patrons in this regard and disclaims any and all liability in this regard.

Security Deposits

Owners may choose to include security deposits in their Postings (“Security Deposits”). Each Posting will describe whether a Security Deposit is required. If a Security Deposit is included in a Posting for a confirmed booking, the owner agrees to collect the Security Deposit at the time of check-in by the Patron. The Owner undertakes to return/ refund such Security Deposit collected at the time of check-out, net of claims, if any. ShavyStays does not undertake to collect such Security Deposit from the Patron, on behalf of the Owner and is not responsible for refund of such amounts back to the Patron, and disclaims any and all liability in this regard. ShavyStays is not responsible for administering or accepting any claims by Owners related to Security Deposits, and disclaims any and all liability in this regard.

Damage to Postings

As a Patron, you are responsible for leaving the Posting in the condition it was in when you arrived. You acknowledge and agree that, as a Patron, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who you invite to, or otherwise provide access to, the Posting. In the event that a Owner claims otherwise and provides evidence of damage, including but not limited to, photographs, you agree to pay the cost of replacing the damaged items with equivalent items. After being notified of the claim and given forty eight (48) hours to respond, the payment will be charged to and taken from the credit card on file in your ShavyStays Account. ShavyStays also reserves the right to charge the credit card on file in your ShavyStays Account, or otherwise collect payment from you and pursue any avenues available to ShavyStays in this regard, including using Security Deposits, in situations in which you have been determined, in ShavyStays’ sole discretion, to have damaged any Posting, including, but not limited to, in relation to any payment requests made by Owners under the ShavyStays Owner Guarantee, and in relation to any payments made by ShavyStays to Owners. If we are unable to charge the credit card on file or otherwise collect payment from you, you agree to remit payment for any damage to the Posting to the applicable Owner or to ShavyStays (if applicable). The Owner agrees that ShavyStays will on a best effort basis try to recover the cost of replacing damaged items from the Patron and that ShavyStays undertakes no further obligation to make good such damages to the Owner. ShavyStays assumes no liability for any acts and omissions of the Patron.

Cancellation and Payment Policy

Minimum 50% advance payment must be paid immediately to confirm booking.Balance amount must be paid at the time of check-in.
If the full amount is not paid at check-in, the booking will be cancelled and no partial payment will be refunded.

A Patron is entitled to a full refund if he/she cancels the confirmed booking 30 days before the Date of Check-In (before 1 PM).

A Patron is entitled to no refund if he/she cancels the confirmed booking less than 30 days before the Date of Check-In (before 1 PM)

Refunds into your bank accounts usually take 7 working days.

If the Patron has made a partial payment, he/she is entitled to no refund whatsoever.

Refund Terms & Conditions

In case of any refunds that ShavyStays owes Patron(s), the processing shall be completed within 7 working days. A nominal cancellation fee of 5% shall be levied for refunds processed by ShavyStays. This is primarily levied to cover payment gateway charges and minimal processing charges.
GST at applicable rates will be charged on this cancellation fee.

Cancellation by ShavyStays

ShavyStays reserves to right to cancel a booking.

Book an alternative comparable available Home.

ShavyStays shall offer Travel Credit (validity of 6 months from date of issuance) of the full amount paid.

A full refund for the total amount paid. The refund shall be processed within 7 working days from the date of cancellation.

Reschedule Policy

Bookings can be rescheduled only at the same home.

If the tariff of the new dates is higher than the tariffs of the original booking, the difference is payable to ShavyStays to confirm the new dates.

ShavyStays allows reschedulement only up to 7 days prior to check-in.

ShavyStays charges 15% reschedulement charge + taxes if he/she reschedules the confirmed booking upto 7 days before the Date of Check-In (before 1 PM).

ShavyStays charges 50% reschedulement charge + taxes if he/she reschedules the confirmed booking upto 2 days before the Date of Check-In (before 1 PM).

Reschedulement charge is applicable, every time a booking is rescheduled.

Relocation Policy

Relocation (to another Home) is not permitted, once a booking is confirmed.

Early Check-in and Late Check-out Policy

Our standard check-in time is 1 pm and check-out time is 11 am.

In case you need an earlier check-in (by 9 am), the rate is 10% of the tariff for that night.

In case you wish to avail a further extended checkout (post 11:00 am), charges are applicable.

The rate is 25% of the tariff for that night for a Checkout up to 3 pm, and 50% upto 6 pm. Full night charges apply thereafter. It is at the discretion of ShavyStays, whether to offer early check-in or late check-out, depending on the availability of the villa.

Processing Refunds

In case of any refunds that ShavyStays owes Patron(s), the processing shall be completed within 7 working days.

A nominal cancellation fee of 5% shall be levied for processing refunds by ShavyStays. This is levied to cover payment gateway charges along with a minimal processing charge.

HOUSE RULES

Govt Id required of all guests for check in ( Pan card not valid )We accept only Aadhaar card, Driving license and passport.

Drinks and Eatable items are not allowed in the pool.

Outdoor music allowed till 10.00 pm – After 10.00 pm music is only allowed indoors with low volume.

Pool Timings – 8.00 am to 9.00 pm. The pool is unguarded. There is no life guard on site.

All children below 10 years must be accompanied by an adult at all times while entering the pool.
